I have disputed it with YouTube. Tomorrow is the deadline for EMI to respond to my dispute.

Similar, but not the same - if anything, it was an influence. And therein lies the rub. There's only so many ways you can mix together A,C, and E chords and have them be different from other songs...which is probably why you can play almost every rock song out there with those three chords...
They're fishing. I'm actually a little surprised you received a take down notice. Most of the time they just have an algorithm trying to match finger prints of their songs, but I have a hard time believing that any computer algorithm would have matched those two songs.
The alternative is to believe that a fine EMI employee, perhaps an intern, was actually watching youtube videos and happened to think your song sounded familiar.
No, I take it back. I don't have a hard time believing that the music industry has hired some shitty programmers to write software that will match up two random songs written in the same key, and played in 4/4 time.

Agreed...A-C-E is almost all of R&R. They can't copyright chords, so agree with anon who says they're fishin'. Of course, they have the deep pockets, so the bottom line would be how far you'd be willing to take it?
